All references to you and your, are deemed to refer to any user and/or visitor of www.thegearchange.com or www.thegearchange.co.za. These terms and conditions govern your use of the website and the forum.
Acceptance of terms
THE GEAR CHANGE permits the use of this website subject to the terms and conditions. By using this website, you will be deemed to have unconditionally accepted all the terms and conditions. You must not use this website if you do not agree to the terms and conditions.

You may only use the website if you are 21 years of age or older. If you are under 21, you may use the website only with the involvement of your parent or legal guardian.

You may not use the website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.

Stolen Gear Policy
We are committed to playing our part in in fighting crime. We are a licensed second hand goods retailer and comply with all the rules and regulations of the draft second-hand goods bill.
As required by the act any person acquiring or disposing of second hand goods to a dealer must furnish such dealer with his or her full name, address and the original of an identity document, or passport as proof of his or her identity.

Sellers must comply to the following:
Be over 21-years, or if under 21, goods must be age appropriate with a written, verifiable consent to sell.
Positive identification: an identity document or South African passport.
Proof of residential address and contact numbers.
Purchases are processed and shipped to your door within 4 business days of receiving payment excluding weekends and public holidays.
On checkout, please ensure that your shipping information is correct. Once your order has been processed, we will not be able to change the shipping address. We will contact you to let your know when your item is on its way, and our courier will communicate an approximate time of arrival.
We offer a flat rate of R85 for shipping your gear anywhere in South Africa for all purchases under R1 000. If you spend more than R1 000 we will ship your gear for FREE!
As a buyer or seller, you are responsible for all shipping charges. The Gear Change reserves the right to choose, at our discretion, the most efficient carrier for your purchase at time of shipment.
The Gear Change will accept returns within seven days of the buyer receiving the item. All items must be returned in 100% the same state as when they arrived- unused, undamaged, and clean.
Upon reception of your product, we will refund your payment in full. However, there is a 10% restocking fee for items returned that are not the fault of The Gear Change.
At The Gear Change, we accurately and honestly describe each item to the best of our ability. If you receive an item that you feel does not fit the attached description, please contact us at firstname.lastname@example.org

The Gear Change will accept cancellations within 7 days of ordering goods. Please inform us at email@example.com of your intention to cancel the order. All items must be returned in 100% the same state as when they arrived- unused, undamaged, and clean.
Upon reception of your product, we will refund your payment in full (excluding courier and related costs).

When purchasing goods at THE GEAR CHANGE payments can be made via electronic funds transfer (EFT) or credit card (Visa & Matercard).
All credit card payments are handled by PayFast (www.payfast.co.za), which is an independent, and secure payment gateway.
Payment for auctioned items:
Payment needs to be made within 24 hours of the final hammer.
For the buyer:
The Gear Change uses an independent and secure payment portal called PayFast (www.payfast.co.za) to ensure safe, secure and swift on-line payment transactions. When paying for your purchase by credit card we will ask you to provide us with the cardholder name, card number, card type, expiry date and CVV number (last 3 digits on the back of your card).
For the seller:
Once your gear is sold, payment excluding our commission, the costs of servicing or any necessary parts, and courier costs (if applicable) is processed within ten business days, which allows for a 7-day return policy for our buyer.
Limitation of liability
THE GEAR CHANGE will not be liable for any injury, loss or damages whether direct, indirect or incidental which might arise from the use or reliance of this website.
You hereby indemnify THE GEAR CHANGE against any claim, damage or loss which you may suffer from using or relying on this website and or any third party site linked to our website.
